The National Industrial Court of Nigeria, sitting in Calabar has adjourned to 5th of May 2016 for further hearing of the suit filed by the suspended Dean of the Faculty of Law, University of Calabar, Prof. Cyril Osim Ndifon against the University.
The case which came up on the 12th day of April 2016, has the University of Calabar, the Vice Chancellor of the University, and the University’s Governing Council as Defendants.
In a short ruling by the presiding judge, Hon. Justice Agbakoba, the court held that the questions raised in the suit contain facts which are hostile, conflicting and cannot conveniently be determined by way of an originating summons or affidavit evidence.
The court therefore adjourned the case to 5th May 2016 and ordered the parties to file pleadings before the next adjourned date.
Professor Ndifon was suspended last year by the University authority after allegations that he raped a 20 year old, 200 level law student in his office.
But in suit No. NICN/CA/01/2016, Professor Cyril Osim Ndifon, is asking the court to determine the legality of the suspension and to upturn same.
