#TDWAJ: Ripples In Cross River Judiciary: Magisterial To High Court And The Lines Between

Introduction

Nigeria practices a democratic form of governance with three organs namely, the Executive, Legislature and the Judiciary.

The three, theoretically operate independently in line with the principles of separation of powers in a bid to ensure check and balances as well as achieve democratic goals and equity.

The Judiciary which is the exclusive preserve of lawyers is said to be the last hope of the common man but, recent happenings have raised suspicions about the true nature of the judiciary.

These include the nature of rulings, judgments to appointments of magistrates, judges, their remuneration, working environment, decay in judicial infrastructure, paucity of staff and legislation among others.

The Cross River judiciary has been in the news for more than a year with oft tagged negative news reports.

The issues range from the position of the Chief Judge to the engagement of magistrates and their non inclusion in the payroll of the state.

What are the issues?

How have they impacted on the justice system?

Have these challenges been there?

With the courts proceeding on annual vacation, will this jeopardize the chances of the issues been resolved?

From the academia to politicians, practitioners and the general public, role do the different stakeholders play

Is there a perfect judicial system? If yes, how can this be achieved? How sustainable will it be?
