Man Threatens Legal Action Against Chinese Company In Calabar

Mr. Michael Nkem, a security staff of Manhattan Security Services Limited, attached to Sinoma International Engineering Company Limited (SHA 600970) with head office at NO. 16, Wangjing North Road Chaoyang District Beijing, China 100102 running the United Cement Company, UNICEM Line2 Mfamosing, Akamkpa local government area, Cross River State, has threatened legal action against SINOMA company for alleged torture, inhuman and degrading treatment by the company’s Administration/Human Resource Manager, Mr. Zhu Jun on September 25, 2014.

In a letter from Mr. Michaels’s legal counsel, Bar. James Ibor with reference number BRC/CAL/SINOMA/VOL.9/71/2014, Nkem demanded for N50, 000, 000 only as compensation for damages.

Excerpts from the letter which was made available to CrossRiverWatch reads, “It is the instruction of our client that in September 25, 2014, Mr. Zhu Jun your Admin/Human Resource Manager at Sinoma/Sinoria Engineering Ltd, UNICEM Line2 Mfamosing, Calabar, Cross River State, Nigeria, without any justifiable reason, kicked our client in his groin and made further attempt to strike him with a metal object but was restrained by a Mobile Police Officer on duty.

Our client was immediately rushed by co-workers to pharmaceutical service shop for first aid and later to a hospital where he was treated for intense pain.

“It is further instruction of our client that we demand the sum of Fifty Million Naira only, from you being compensation for the torture, inhuman and degrading treatment meted out on him by your employee. Take notice that we shall after two weeks of the service of this notice, commence legal action against you and your employee”.

When Mr. Nkem was contacted he further revealed that “I was falsely accused of stealing 1.5 meter of cable valued at 150 million naira according the my accuser Mr. Zhu Jun, several attempts at arresting me were made but to no avail, later after internal investigation it was discovered that the missing cable is 59 meters which I did not steal because I am not the one posted to the location where that cable was kept and besides no one is usually posted there, till date nothing has been said about my medical bills and my salary has not been forthcoming as before”.

An eye witness who happens to be a colleague of the complainant, Mr. Akpandem Effiom told CrossRiverWatch that, “I am one of the security men posted to labor camp to work that day because we work on 24 hours shift. The camp is a large area with residential quarters where the Sinoma Chinese men stay and a cable site.

“I was posted to the residential area while Nkem and Solomon Bassey was posted at the cable site in this camp, also there is an extension called transformer area where they are trying to install transformer and usually nobody is posted there, half drum of cable base was taken from the cable site to the transformer area which was used and remaining left there.

“On that faithful day in the morning around 6:30am Mr. Zhu passed us and went to the transformer area and by the time he came out, he called our supervisor to that place who in turn called the two of us because Solomon Bassey had taken excuse to go early, we were told that an intruder might have entered through a hole beneath the fence and stole some cable, before now we had drawn the attention of Sinoma to that hole for it to be filled but deaf ear was given to us.

“Mr. Zhu now requested for who was posted there and asked Michael if he is the one but in the process of answering while he was saying he wasn’t posted there, he knows nothing about the missing cable Mr. Zhu who is a good karate fighter kicked him below his abdomen when Nkem fell, he then turned around and picked a rod attempted to hit Michael if not for corporal Emmanuel of the Mobile police force posted there also who stopped Zhu after which the policemen were ordered to arrest us without allowing us prove our innocence.

“Here, UNICEM has a rule of no fighting and in anything as such, the guilty one is to be immediately relieved of his or her duty, our company’s agreement with them is that when anything get missing our company will take charge of replacing it but as we speak the way Michael was treated is very bad that is how this Chinese people treat people without respect and regards. Let the community and any good spirited individual come into this matter because one day we will wake up to find out no indigene is gainfully employed by community slot which is what gave our company the job with Sinoma”.

When CrossRiverWatch contacted the director of Security of Manhattan to Sinoma, Engineer Asi Otu Iso he said, “You are grossly misinformed, I can’t talk to you until I get directives from my boss to talk to you, you are grossly misinformed”.

When CrossRiverWatch tried to reach Mr. Zhu, his line was switched off .

As at the time of filing this report, the legal team of Mr. Zhu Jun (Amah, Okon and Associates) had replied the counsel to Michael Nkem claiming that their client stole the missing cable.

    There are two crucial issues here: (1) The presumption of innocence until one is proven guilty; and (2) The fact that the legal system provides for a process whereby anyone suspected of having committed a crime has to either be arrested or sued in a court of law. No one has to right to mete out punishment to an accused outside of the confines of the law. If people are allowed to enforce justice on their own, what we will have is anarchy. If indeed Mr. Zhu Jun did what he is accused of doing, he deserves to face the law as he is rightly being sued by Mr. Nkem. No one in his right mind will recommend that Mr. Nkem kicks Mr. Jun in the grain too; assuming that that was what happened to Mr. Nkem. The legal system is there for the protection of everyone and we should take advantage of its provisions rather than taking the law into our own hands.

    I heard from my friend that Mr. Zhu always give out like five hundreds and one thousands to poor little kids and homeless on street, also I do heard that their company cable which is more than one million Naira for each time was stolen at night, I do not have much to say hopefully some insiders can reveal the whole story and give the justices back the person who deserves! Law is watching everybody and God is going to punish guilty people!

    I happen to be Close to the Workers and I have a Younger Brother Working as a Labour in Sinoma/Sinoria..in which The Subject in question Zhu Jun is his boss. Personally I have met Zhu Jun about 3 times. And as Heavens will have it, i was with him on the very day the cable theft happened. In my candid words. Most times we Nigerians view a white skin fellow as a huge avenue to make money. . WHY? Zhu Jun simply asked Michael Nkem about his missing Armoured Cable on that faithful day and Michael became arrogant saying “he was on guard throughout” and he doesn’t know the whereabouts of the cable in question. He became arrogant and had a heated argument with Zhu saying “this is my country, and you are a poor Chinese prisoner) heading towards Zhu pushing him on his chest. He was all smelling with Alcohol (Michael Nkem). I feel he did all those display to block the fact that 1.2 million naira armoured cable was missing on his guard duty watch. On trying to kick Mr Zhu, we all rushed to hold him. That was where I smelt alcohol from him “Michael Nkem”. I read this article of Sue of 50million. Where on earth is this lie coming from that Zhu Jun hit you Mr Nkem???. @ ESE, James Ibor and Lehweetu. Please investigate before you speak and don’t try to be myopic in Ur judgements. As we speak till today, Michael Nkem is still working for Zhu Jun and he was paid for September and October salary. (BEHOLD YOU SAY HE IS NOT GOOD) Please allow the nice Chinese Man to have his peace and help build infrastructures with their cutting edge technology to develop your country.     Truth is truth. No one can justice by himself. No one can hide truth by touching words. Yes, god is watching everybody! If anyone has right, he can sue for his right. As I understood, Michael is pretending a victim and he wanted to conceal his criminal act and spread a wrong message in order to get more supports. But, here is not a court. If Michael is right, he doesn’t need any help from media! Prison is waiting for offender.

    I like your reply Mr. Comrade, personally Mr.Zhu is really a nice man and he is akways humble, a lot of people were coved by eyes and misunderstook him, just put your feet into Mr. Zhu‘s shoes and ignore him is a chinese people then you might be not feel

      Is 50million a compensation or blackmail? I think Zhu is open to every qualified government functionary to check out his statue, respect should be mutual, when thieves stole their cable did they ever think about respect? From my opinion Chinese people helped Nigeria and they are doing and they still will in the future, this bil-country relationship will be even better than before, so Nkem you are supposed to stand out and revel the truth and do a security people’s job, speak out who stole the cable! And give Zhu’s reputation and His company reputation back! Don’t make this problem worse!

    This is Nigeria, China. There are provision by law to put in shape any defaulter, this so call Mr Zhu is he human or a monkey, what is the meaning of Zhu if I may ask, some of this immigrant with names unknown to us should better be rename, who know why he is behaving so inhuman, he may be animal and we don’t know. For the Mobile Police on duty in that company and other, I blamed them! Atimes we mortgage our country for peanut, was there no able bodied men to teaching this good for nothing Zhu a lesson? What a pity that you are not working as an embassy staff since You are so so caring about these China and Nigeria things and even call a Chinese people a monkey? Do you even ever know what is respect? And about this defame China and Zhu I think Nigeria still has the relevant law to punish defaulter!     Is China not far from Mfamosing. Zhu should face the wrath of the law for being so inhuman, Nkem should be paid whatever compensation he demand as this will serve a deterrent to others! First the Nigerian Immigration Service so a certain the guinuity of Zhu stay in Nigeria or is he an undocumented immigrant? As a documented immigrant he should have respect for this Country, is Nigeria too small that he cannot respect, imagine the maltreatment given to Nigerian in Nigerian, woe betide him!

      Mr. MIC, were you there at the scene when all of these happened? If yes why didn’t stop it and reported earlier? If no then stop talking nonsense! Nkem returned good for evil reverseditself and some other people taking advantage to set fire!!! What are these thinking!
