The Court of Appeal, Abuja Division yesterday heard the appeal filed by Mr. Joe Agi, SAN, against the judgement of the Federal High Court, Abuja Division presided over by Justice Abdulkarafati declining jurisdiction.
Recall that in April 2015, the Federal High Court, Abuja, declined jurisdiction to hear a pre-election matter brought by Joe Agi against Governor Ben Ayade and the Peoples Democratic Party (PDP) seeking a nullification of the nomination of Governor Ayade as the governorship candidate of the PDP on the ground of perjury.
The court consequently threw out the matter but Mr. Joe Agi SAN proceeded to the Appellate Court to appeal the matter which was heard yesterday.
After Counsel to both parties adopted their brief of argument, the Court of Appeal reserved its Judgement. The presiding Judge said parties will be notified whenever its judgement is ready.
In the case, Joe Agi is seeking an order that he should be declared the Governor of Cross River State of Nigeria because his opponent was not eligible to contest PDP Governorship Primary Election which produced him as the governorship candidate of the Party in the last governorship election in the State.
