Human Rights Violations: Cross River Magistrate Appeals High Court Judgment Awarding Him N1 Million

A Cross River State Magistrate, Eno Iyamba has filed an appeal against the judgment of the Federal High Court of Nigeria, Calabar Division which awarded him damages of one million Naira over the violation of his fundamental rights by airmen of the 305 Special Mobility Group, Nigerian Air Force, Cross River State Command.

In a Notice of Appeal filed on Tuesday 27 September 2022, the Appellant raised four grounds for appealing the judgment that awarded him damages but failed to consider some of the reliefs sought before the lower Court, he maintained.

The Appellant added that the paltry sum of one million Naira damages awarded is ridiculously low, unreasonable, and not commensurate with the intensity of pain and injury suffered.

It would be recalled that the Federal High Court of Nigeria, Calabar Division presided over by Justice Rosemary Dugbo Oghoghorie had on July 1, 2022, in suit No. FHC/CA/FHR/63/2021 entered judgment against the Nigerian Air Force and in favor of the Magistrate over violation of his fundamental rights to personal liberty, and dignity of the human person, and the sum of one million Naira only was awarded as damages by the trial Court.
