A High Court of Cross River State sitting in Calabar presided over by Justice Isoni Francisca has set Friday, September 13, 2019 to deliver its ruling on a motion of jurisdiction entered by the Police in an enforcement of fundamental human rights suit filed by journalist and activist, Agba Jalingo who has been detained for 20 days since his arrest on August 22, 2019.
Jalingo’s lawyers had approached the court after he spent a week in detention demanding his release but, the Police claimed it had obtained a Court order to detain him for 14 days.
The Police had initially refused to be served and after a motion of substituted service was granted, the prosecution counsel, Dennis Terhemba argued that the State High Court lacked jurisdiction to entertain the case as charges had been filed against Jalingo at the Federal High Court.
Mr. Jalingo was accused of treason, terrorism, cultism and attempts to topple the Cross River State Government and is yet to be charged to Court.
