A Federal High Court sitting in Calabar and presided over by Justice Rosemary Dugbo Oghoghorie on Thursday nullified the Primaries of the All Progressives Congress, APC for the Yala 2 State Constituency, thereby sacking lawmaker, Honorable Cynthia Nkasi as the candidate of the party and barring her publication as a candidate for the 2023 polls.
In the judgment delivered on Thursday, Justice Dugbo held that the plaintiffs in suit number FHC/CA.CS/140/2022, clearly demonstrated that Mrs. Nkasi did not emerge as a candidate through due process of law.
The plaintiffs in the suit were the People’s Democratic Party and its candidate for the polls, Dr. Martins Achadu while the Independent National Electoral Commission, APC, and Mrs. Nkasi were listed as the first, second, and third defendants respectively.
The plaintiffs had approached the Court seeking an order to nullify the nomination of the third defendant since the first defendant did not monitor the primaries conducted by the second defendant.
Justice Dugbo granted the prayers of the plaintiffs for an order nullifying the first defendant’s publication of the name of the third defendant as the candidate of the second defendant to contest with the first and second plaintiffs.
Justice Dugbo also ordered the first defendant not to accept, recognize or include the third defendant as the candidate of the second defendant to contest against the plaintiffs in the March 2023 elections.
