It has been 10 days since Justice Taiwo Taiwo of the Abuja division of the Federal High Court sacked 20 lawmakers from Cross River State for defecting to the All Progressives Congress (APC).
The People’s Democratic Party (PDP) had taken the federal lawmakers representing Obubra/Etung federal constituency, Mike Etaba and the Obudu/Obanliku/Bekwara federal constituency, Legor Idagbo as well as 18 other members of the State House of Assembly who left the party in 2021 to seek redress having been elected on the platform of the PDP.
Their prayers were granted by the Court. And, the judgment order obtained shows that Justice Taiwo ordered that the lawmakers were not entitled to occupy the offices.
Justice Taiwo made an order of injunction restraining the lawmakers, individually and collectively from acting in any manner whatsoever relating to the offices they were elected on the platform of the PDP.
Also, the Court restrained the Independent National Electoral Commission (INEC), the Speaker of the Federal House of Representatives, the Clerk of the National Assembly, the Cross River State House of Assembly and the Clerk of the Cross River State House of Assembly from recognizing the lawmakers, according to them or giving them access reserved for those occupying the seats which they have been ordered to vacate.
Furthermore, Justice Taiwo ordered that INEC receives from the PDP, a list replacing the sacked lawmakers or conduct an election within 90 days to fill the vacant seats.
